Discord has stated that it has not yet been formally served with a subpoena from Take-Two Interactive regarding the Grand Theft Auto VI leaks. The company indicated that upon receipt, it will thoroughly evaluate the validity and scope of the subpoena before issuing a response. This comes after reports that a U.S. District Court judge granted Take-Two's request to subpoena Discord for identifying user information potentially linked to the leaks.

Take-Two also secured a subpoena for Microsoft, which the company has stated it is willing to cooperate with. However, Discord's marketing director, Ryan K. Rigney, clarified the platform's stance via Twitter, emphasizing that the company has not yet been served. The subpoenas are related to alleged Digital Millennium Copyright Act (DMCA) infringement and seek identifying information connected to the user account ‘CyberLeek,’ which is believed to be behind the dissemination of GTA 6 assets. The requests extend to user accounts that were members of specific Discord servers and participated in conversations within them since June 1.

One of the servers mentioned in court filings is 'discord.gg/darkviperau,' an editors' server associated with GTA content creator Matthew "Matt" Judge, known online as DarkViperAU. Judge has denied any involvement in wrongdoing. Critics, including the free speech and privacy advocacy group Reclaim The Net, have voiced concerns that these subpoenas could be used to pursue identifying information from users who did not leak or upload footage but merely participated in discussions about the leaks on Discord.

Reclaim The Net argued that Take-Two's filings suggest a broad targeting of entire communities and channels, rather than solely focusing on direct infringers. They characterized this as an attempt to obtain membership lists under the guise of copyright enforcement, noting that the DMCA process is relatively inexpensive and quick for filers, with compliance costs falling on platforms. Concerns were raised that companies are becoming more aggressive in their pursuit of information, extending beyond direct infringement.

It remains unclear if Microsoft has been served with its subpoena, though court documents suggest Microsoft may have already initiated its own investigation into the CyberLeek account. A subpoena for Twitter/X has also not yet been signed off, though this is expected to be a formality. Meanwhile, the GTA 6 leaks are ongoing, with fresh concerns arising about potential story spoilers being released by CyberLeek. Neither Rockstar Games nor Take-Two Interactive have officially commented on the matter. Grand Theft Auto VI is scheduled for release on PlayStation 5 and Xbox Series X/S on November 19, 2026.
