Epic and Roblox Face Lawsuit Alleging Deliberate Exploitation of Game Addiction

A lawsuit filed in San Francisco against Epic Games and Roblox alleges that the companies deliberately design their popular titles, including Fortnite and games on the Roblox platform, to exploit psychological techniques and foster addiction for financial gain. The suit, brought by 23-year-old Dawson Little, claims these "behavior modification systems" have led to severe emotional distress, anxiety, depression, and academic failure.

Little, who reportedly played Fortnite and Roblox extensively as a minor, asserts that the games "weaponize a video game for the unethical, reckless, and/or negligent application of this psychological technique to encourage a negative response as to the gamer and the positive outcome of increased revenue for the defendants." The filing contends that exposure to these systems resulted in "physiological and psychological results and resulted in a disordered relationship with, and addiction to, video games."

While the suit draws a parallel to addiction concerns that have historically surrounded video games, it distinguishes itself by focusing on the alleged deliberate use of techniques also employed in gambling. However, the lawsuit's filing has been described as containing significant flaws, misusing psychological terms, and invoking unproven conditions like "Internet Gaming Disorder" as established medical facts. The Diagnostic and Statistical Manual of Mental Disorders, fifth edition (DSM-5), lists IGD as a condition requiring further research, not a recognized disorder.

The legal document has been criticized for its hyperbolic claims, including comparisons of game addiction to heroin and unsubstantiated assertions about a "public health crisis." It also appears to mischaracterize Roblox as a single game rather than a platform for user-created content. The suit reportedly includes lengthy, repetitive arguments and contradictory statements, such as detailing Fortnite's compelling mechanics as evidence of its unfair appeal.

Despite the filing's perceived weaknesses, the case presents an opportunity for a broader discussion on the psychological techniques embedded in modern games, particularly those targeting younger audiences. A successful prosecution or even a public trial could bring increased scrutiny to the compulsion loops used in game design. However, it is widely expected that Epic Games and Roblox will seek to have the case dismissed, though the possibility of a settlement remains should the case proceed.
