Nintendo is seeking to dismiss a class-action lawsuit filed by consumers who claimed they were owed refunds for increased prices attributed to tariffs imposed by the Trump administration. The company argues that it has no legal obligation to pass tariff-related refunds onto customers, stating that those who purchased Nintendo products at the adjusted prices "received exactly what they bargained and paid for."
The lawsuit, filed in April, alleged that American consumers paid higher retail prices for goods, including Nintendo products, due to the economic burden of these tariffs. Plaintiffs contended that these increased costs should be refunded.
In its filing, Nintendo countered that it raised prices to reflect tariffs and other rising costs, similar to market peers. However, the company noted that it did not implement an across-the-board tariff surcharge. Instead, Nintendo stated it made "modest and selective price adjustments" and absorbed the costs for some of its most popular products, including the Nintendo Switch 2, which maintained its $449.99 launch price despite the tariffs.
Nintendo maintains that consumers ultimately chose to purchase products at the elevated prices, and therefore, they are not entitled to compensation. The company suggested that consumers had the option to "abstain from purchasing the product or [seek] out competing products."
The resolution of the case now rests with the courts, which will decide whether to dismiss the lawsuit or allow it to proceed. This dispute over tariffs and pricing also occurs amidst broader industry challenges, including a computer component crisis that has prompted price increases for consoles from Sony and Microsoft, and an upcoming $50 price hike for the Nintendo Switch 2 scheduled for September 1.
